Will of Samuel Decker of Shawangunk, Ulster County New York
Volume P, Page 769

At a Surrogates court held in and for the County of Ulster at the Surrogates Office in the Village of Kingston on 27th day of July 1869
Present Charles A. Fowler, Surrogate

The last will and testament of Samuel Decker was admitted to probate and proved as a will of real and personal estate which together with the proofs taken in relation thereto are as follows:
In the name of God Amen I Samuel Decker of Shawangunk Ulster County being of sound desposing mind and memory Do make and publish this my last will and Testament in manner and form following-
First - I direct that all my just debts and financial expenses shall be paid by my executor hereinafter named -
Second - I give devise and bequeath to my two nephews Philip T. Decker and Samuel T. Decker sons of my sister-in-law Elizabeth Decker all that lot of land containing about fifty acres now rented by said Samuel from me; also Seventy acres off the Southerly part of my Homestead Farm adjacent to the Southerly line thereof and to be located by running a line parallel to said Southerly line and so far north of it as to include and make up said seventy acres; to hold Said lands share and share alike; but subject to the payment of legacies hereinafter mentioned -
Third - I give devise and bequeath to my sister-in-law Elizabeth Decker widow of my deceased brother Thomas the use and enjoyment of all the residue and remainder of any real estate and of all my personal estate for and during her natural life and I give devise and bequeath the same in fee simple to her two sons William Decker and James Thomas Decker share and share alike but subject to their mother's life Estate in said land and personal Estate -
Fourth - I give and bequeath to my two nieces Jane Miller and Mary Terwilliger the sum of Fifty Dollars each and to my niece Sarah Ann Decker the sum of One Hundred Dollars - and I direct that said legacies shall be paid to them respectively by my said nephew Philip T. Decker and Samuel T. Decker equally in one year after my decease without interest and the payment thereof is made a charge on the lands herein devised to them -
Lastly - I hereby constitute and appoint my nephew Philip T. Decker sole executor of this my last Will and Testament hereby revoking all former and other wills by me made -
In witness thereof I have hereto set my hand and seal this twenty ninth day of June one thousand eight hundred and sixty -

The above instrument was now here subscribed by Samuel Decker the Testator in presence of each of us and was at the same time declared by him to be his last Will and Testament and we at his request sign our names hereto as attesting witnesses -

In the matter of proving the last will
and testament of
Samuel Decker deceased
James G. Graham of the town of Newburg in the County of Orange being duly sworn and examined before Charles A. Fowler Surrogate of the County of Ulster deposes and says that he was well acquainted with Samuel Decker the testator now deceased, that he was present as a witness and did see the said testator subscribe his name at the end of the instrument in writing now produced and shown to the deponent, bearing date the 29th day of June in the year one thousand eight hundred and sixty purporting to be the last will and testament of the said testator. That the said testator at the time of making the said subscription declared the instrument so subscribed by him to be his last will and testament and requested this deponent to sign his name as a Witness thereto. Thereupon this deponent accordingly signed his name as a witness at the end of the will at the request of the testator. This deponent further says that the said testator at the time he executed the said instrument was a citizen of the United States, of full age, of sound mind and memory and not under restraint and that this deponent saw George G. Graham of the town of Shawangunk in the County of Ulster, sign the said instrument at the said time as a witness in the presence of the said testator and at his request.

In the matter of proving the last
Will and Testament of
Samuel Decker deceased
Ulster County ss: John M. Schoonemaker of the town of Kingston being duly sworn and examined before Charles A. Fowler surrogate of Ulster County, doth depose and say, that he was well acquainted with George G. Graham late of the town of Shawangunk in the County of Ulster but now deceased and with his manner and style of handwriting having often seen him write, and that he verily believes that the signature of George G. Graham signed as a witness to the instrument in writing now produced and shown to this deponent having date the 29 days of June in the year one thousand eight hundred and sixty - purporting to be the last will and testament of Samuel Decker deceased is the true and genuine handwriting and signature of the said George G. Graham and the said George G. Graham aforesaid deported this life on the 3 day of May 1866

Note from David: that Samuel Decker (b.Oct. 18, 1789 - d.bef. July 27, 1869) of
the will you enclosed is the son of Petrus G.(Petrus-Jan B)Decker,6 (b.Feb. 3,
1759 - d.July 28, 1840) and Annatje Decker (b.June 23, 1761 - d. Feb. 16,
1813) of Shawangunk, Ulster County.  I don't think he ever married, but
his brothers and sisters did and thus the mention of nephews and nieces.
He is back in the Jan B. family line but not significant to our Decker
line.  Thanks for the information though.
